Agreeing to these terms
These terms cover your use of the Benchmark Brownsville Concrete Coatings website and any estimate, scheduling or work you arrange with us through it. If you use the site, contact us or book a job, you agree to these terms. If you don't agree, please don't use the site.
A written estimate, proposal or job agreement for your project may add to these terms. Where it differs from this page, the signed job paperwork controls for that job.
What we do
We're a flooring contractor in Brownsville, TX. We coat, polish, stain, seal, grind, resurface and repair concrete floors for homes and businesses in Brownsville and the cities around it. You can see what we offer from the home page and learn more about our crew on the About page.
Service descriptions, photos and examples on this site are general information. Your floor's condition, size and use decide what we can do on your job, and we'll confirm the scope in your estimate.
Estimates and pricing
Estimates are free and come with no obligation. We usually need to see the floor in person, because cracks, old coatings, moisture and the condition of the concrete change the prep work and the price.
An estimate is based on what we can see and what you tell us. If we find something once the job is open, such as hidden damage, old adhesive or moisture coming up through the slab, we'll stop, explain it and agree on any change in price or scope with you before we go on.
Prices on any estimate are good for the period written on it. After that, material costs may have changed, so we may need to update the figure.
Scheduling, access and cancellation
We set a start date together once you approve the estimate. Weather, humidity, curing times and material delivery can move the schedule, and we'll tell you as soon as we know about a delay.
You agree to give our crew safe access to the work area, clear it of vehicles, furniture and stored items unless we've agreed to move them, and keep people and pets off the floor until we say it's ready. Walking on or loading a coating before it has cured can ruin the finish, so we can't be responsible for damage from early use.
If you need to cancel or reschedule, please call us at (956) 505-5381 as early as you can. If we've already ordered special materials or started prep for your job, your job agreement may let us charge for those costs.
Payment
Payment terms, including any deposit, are written on your estimate or job agreement. Unless that paperwork says otherwise, the balance is due when the work is finished.
If a payment is late, we may pause further work until it's settled. You're responsible for any reasonable costs we have to pay to collect an unpaid balance, as far as Texas law allows.
Warranties and what they don't cover
We stand behind our work, and if something isn't right, we want to hear about it so we can make it right. Any written warranty for your job is the one on your job agreement, along with any warranty the coating or product maker offers on its own materials.
Concrete moves and holds moisture, so no one can promise a slab will never crack. Our warranty doesn't cover cracks or movement in the concrete itself, moisture or problems in the slab we couldn't reasonably find, damage from misuse, chemicals, hot tires, heavy impacts, flooding or weather, or wear from skipping the care steps we give you.
Apart from any written warranty on your job agreement, the website and its content are provided as they are, without promises of any kind, as far as the law allows.
Limits on our liability
As far as Texas law allows, our total liability for any claim about a job is limited to the amount you paid us for that job. We're not liable for indirect or follow-on losses, such as lost business, lost use of a space or the cost of storing your belongings during the work.
Nothing on this page limits any right you have that the law doesn't let a contract take away.
Using this website
You may use this site to learn about our services and get in touch with us. Please don't copy our photos or text for commercial use, try to interfere with how the site works or send us false information through the contact form.
The site may link to other websites. We don't control them and aren't responsible for what they say or do.
Settling a disagreement
If you have a problem with our work or a bill, call us first. Most issues get sorted out quickly when we can look at the floor together, so we ask that you give us a fair chance to fix things before taking other steps.
If we can't resolve it that way, any legal claim will be handled in the state or federal courts serving Cameron County, Texas, unless your job agreement says otherwise.
Governing law
These terms and any work we do for you are governed by the laws of the State of Texas, without regard to rules that would apply another state's law.
Changes to these terms
We may update these terms from time to time, and the version posted here is the one that applies when you use the site. Changes won't alter the terms of a job agreement you've already signed.
